Companies that violate GPL may also be violating federal law.
"Linux products are generally covered under GPL which among other things mandates that the source code must be available. Violating the terms of GPL is usually not a big deal and the offending companies are generally made to merely release the code, but Wasabi says that Sarbanes-Oxley makes this much more complicated." Novell Wins Remand Contest- Case Stays in Federal Court - It's Copyright Proof Time
Judge Kimball, as he promised, has issued his order* on the Novell case. The big news is that SCO lost its fight to get the case sent back to state court. SCO's entire theory of the case as a contract issue only went out the window, and they are now squarely in a pure copyright fight, which is the last thing they wanted. They will now have to prove that they own the copyright they are using to threaten end users like AutoZone. Kimball agrees with Novell that there are serious questions about whether the agreement even as amended by Amendment 2 is sufficient to be a copyright conveyance, and that means it stays in federal court. He retains jurisdiction. Remember all the experts who told us SCO might win this? They were mistaken....Read More at groklaw

SCO Loses Motion to Bifurcate - SCO Motion to Delay Partly Denied, Partly Granted
There is no moss growing on the Honorable Dale Kimball. Now comes word that SCO's Motion to Bifurcate the patent claims has also been denied without prejudice to renew after all dispositive motions have been decided. That is what IBM said made sense to do, wait until it is clear what is actually going to trial. Personally, I am guessing that would be nothing. What a waste of time it was to even bring this motion now. Perhaps that was the purpose....Read More at groklaw

Grokline's UNIX Ownership History Project
This is an open, community-based, collaborative research project, a living history, designed to carefully trace the ownership history of UNIX and UNIX-like code with the goal of reducing, or eliminating, the amount of software subject to superficially plausible but ultimately invalid copyright, patent and trade secret claims against Linux or other free and open source software. If there is any code out there that represents a conceivable risk of that kind, we'd like to identify it and mitigate the litigation risk now. Bradley M. Kuhn,Tuesday 18 May 2004, FSF: Late last year, we were subpoenaed by SCO as part of the ongoing dispute between SCO and IBM. Today, we made that subpoena available on our website. This is a broad subpoena that effectively asks for every single document about the GPL and enforcement of the GPL since 1999. They also demand every document and email that we have exchanged with Linus Torvalds, IBM, and other players in the community.
